Uncontested Divorce

New York City Uncontested Divorce Lawyer

Divorce is an overwhelming process where no one truly wins. A home is broken. However, sometimes, it is the best for everyone involved. Many people enter divorce with bitter feelings and want nothing more than to make the future of their spouse agonizing by fiercely litigating decisions involving property division and child custody. However, an amicable resolution is often less traumatic on everyone involved - especially your children. At the Law Office of Paul B. Groman, we advise and represent clients in uncontested divorce and divorce mediation.

Our family law firm has been advising individuals and families for nearly ten years. We have the experience and comprehensive knowledge to explain your divorce options and advocate for your rights. Benefits of Uncontested Divorce

An uncontested divorce is one in which the husband and wife agree on all of the issues related to their divorce and sign a marital termination agreement which is submitted to the court. The court then enters a divorce decree (Judgment of Dissolution of Marriage) based upon the parties' agreement. Uncontested divorce is often favored by divorcing couples for many reasons:

  • More efficient: Many decisions in an uncontested divorce are already agreed upon, making the process quicker to conclude. In addition, it is often more efficient to resolve contested issues through negotiation or divorce mediation than to wait for a trial date.
  • Less expensive: By working together to negotiate property settlement agreements and child custody agreements, couples are capable of avoiding expensive litigation costs and prolonged need for an attorney.
  • More control: Couples are capable of maintaining control in the important decisions that will impact the rest of their lives and the lives of their children.
  • Emotionally easier: By avoiding bitter disputes, couples are able to avoid further emotional trauma (especially to the children) and promote healthier relationships for the future (which is essential when raising the children).

When is Uncontested Divorce or Divorce Mediation Appropriate?

Uncontested divorce is an appropriate option for people who agree (or who can commit to negotiating an agreement) on all issues in the divorce, including property division, child custody, visitation, alimony/spousal support and other matters. Attorney Paul Groman assists these clients in drafting divorce settlement agreements and obtaining court approval of the agreement.

However, even when all issues are not decided, uncontested divorce may still be a favorable method for resolution. As an experienced divorce lawyer, Mr. Groman can guide clients through the divorce mediation process. Couples are able to come together in a neutral, open environment and work through issues and decisions for the future. Once an agreement is reached, our firm assists in preparing the documentation for the divorce settlement.

If decisions cannot be reached through divorce mediation, or it is not in a client's best interest to proceed by an uncontested divorce, our firm provides zealous representation through the contested divorce process.
