In 2005, new laws were passed that changed the bankruptcy code and made it more difficult for certain people to file bankruptcy. That this does not mean you cannot file bankruptcy. The biggest change the law put into place is "means testing" to determine if the median income of a family is above a threshold amount. If their income is less then the state median, it is usually not a problem to file a traditional bankruptcy. If it is higher then the median the bankruptcy court will ask for more information about the income, debt, assets, and property of the person filing to determine if they are still eligible.
